MINUTE APPROVAL JULY 9, 2019 REGULAR TOWN BOARD MEETING: Councilwoman Marien motioned to accept the minutes of the July 9, 2019 Regular Town Board meeting. Councilwoman Ross seconded the motion. 4 ayes, 0 nays. MOTION CARRIED.
SUPERVISOR’S JUNE 2019 FINANCIAL REPORT: Councilman Muffoletto moved and was seconded by Councilwoman Marien to accept the Supervisor’s June 2019 Financial Report as presented. 4 ayes, 0 nays. MOTION CARRIED.

TOWN CLERK/TAX COLLECTOR’S JUNE 2019 FINANCIAL REPORT: Supervisor DeCarlo motioned to accept the Town Clerk’s June 2019 Regular Financial Report and the Tax Collector’s Report, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
COURT CLERK’S JUNE 2019 FINANCIAL REPORTS FOR JUSTICES GIER AND KACZMAREK REGULAR AND BAIL ACCOUNTS: Supervisor DeCarlo motioned to approve both Bail and Regular Financial accounts for Justice Gier and Justice Kaczmarek for June 2019, and was seconded by Councilwoman Ross. 4 ayes, 0 nays. MOTION CARRIED.
CODE ENFORCEMENT OFFICER’S JULY 2019 REPORT: Code Enforcement Officer Brecker was not present. Tabled to the September Meeting.
DOG CONTROL OFFICER’S MAY and JUNE 2019 REPORTS (JULY REPORT TABLED): Supervisor DeCarlo motioned to approve the reports as read, and seconded by Councilwoman Ross. 4 ayes, 0 nays. MOTION CARRIED. June’s report is tabled to the September Meeting.
POLICE REPORT JULY 2019: The July 2019 Police Report was read by Supervisor DeCarlo. The report stated there were 4 animal complaints and 1 Dog Control Officer assist. Supervisor DeCarlo motioned to approve the report as read, seconded by Councilwoman Ross. 4 ayes, 0 nays. MOTION CARRIED.
HIGHWAY SUPERINTENDENT’S JULY REPORT: The Highway Report for July 2019 was presented by Supervisor DeCarlo.
Councilman Muffoletto asked about fuel being used to help other towns. Are those towns fueling our trucks? Supervisor DeCarlo said he would find out. Supervisor DeCarlo motioned to approve the report as read, and seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
TOWN CLERK’S REPORT TO THE BOARD: Town Clerk Daniel read her June Report. She said that she received a request from the Town of Hanover to use her wide format scanner to digitize their vital records. In keeping with New York States “Shared Service” requirements, she approved the request. The scanning would be conducted here. The Town Clerk then requested that the Town Clerk’s smaller scanner be returned to the Shared Town Office, located across from the Police. A key to the office will be given to the Court Clerks. Councilwoman Ross stated she had spoken with the Court Clerk’s who stated they don’t have the authority to allow the scanners to be moved. The Town Attorney advised that the scanner is the Town Clerk’s equipment. The Town Board ordered the scanner to be moved.
The Town Clerk then advised the Board that David Sink has requested we renew the Town’s PC Matic virus protection for the server and 9 computers. The renewal is for 3 years. The total cost is $559.82. Supervisor DeCarlo motioned to approve the Town Clerk’s report, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
APPROVAL TO PURCHASE PC MATIC RENEWAL: Supervisor DeCarlo motioned to approve the purchase of the PC Matic virus protection for $559.82, and seconded by Councilwoman Ross. 4 ayes, 0 nays. MOTION CARRIED.
PLANNING BOARD MINUTES: The August Minutes will be tabled to the September Meeting.
ZONING BOARD OF APPEALS REPORT: No meeting held.
RECREATION DIRECTOR’S REPORT: Councilman Muffoletto stated there was a fender bender at the High School. No injuries were sustained. It was in the construction area.
PARKS COMMISSIONERS’ REPORT: Tabled to the September Meeting.
TOWN HISTORIAN’S REPORT: No report. Tabled to the September Meeting.
FIRE COMPANY REPORTS: No reports.

Acknowledgement of the floor for Visitors, Invited Guests and Presenters:
Karl Sinneth from Assemblyman DiPietro’s Office. He advised that the legislature recently conducted a Legislative Meeting in Strykersville. When there is a meeting in Erie County, he will be sure to let us know.

QUOTE TO INSTALL CAMERAS AT HIGHWAY: Supervisor DeCarlo said he is trying to get to talk to the utilities since it was their pole that came down and broke our cameras. The quote that we have includes a new recorder because the new cameras may not be compatible with the old recorder. This will be tabled until the September Meeting.
Reappoint Joseph V. DeCarlo as Town Assessor for the term October 1, 2019 – September 30, 2025. Councilman Muffoletto made a motion to reappoint Joseph DeCarlo as Town Assessor, seconded by Councilwoman Marien. Roll call vote was taken: Councilman Muffoletto-aye, Councilwoman Marien-aye, Councilwoman Ross-aye, Supervisor DeCarlo-Abstain. 3 ayes, 0nays, 1 abstain. MOTION CARRIED.
Shred-It Proposal: Supervisor DeCarlo received a proposal from Shred-It which is a company that does secure shredding. The company is under NYS contract. They would supply a couple of bins to the Town Hall, one for the courts and one for the rest of the offices. Total fees $78.50 per month. Councilman Muffoletto asked if we could possibly get an industrial type shredder. The Supervisor said we could look into it but there is no guarantee on how long it would last. Councilwoman Marien motioned to approve the Shred-It contract, and seconded by Councilwoman Ross. 4 ayes, 0 nays. MOTION CARRIED.
Approval to update the AED (Defibulator): We have 2 units, one at the Town Hall and one at the Town Park. Councilwoman Marien asked if there is a grant that we could use. Supervisor DeCarlo said he will look into a grant for two new ones. This will be tabled until the September meeting.
Approve resignation of Raymond Ashton, Patrolman for retirement purposes 7/26/19: He needs to retire from this job and then rehire as a new hire. A motion was made by Supervisor DeCarlo to accept the resignation of Patrolman Raymond Ashton, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
Approve rehire of Raymond Ashton, Patrolman at previous rate of pay 8/2/2019. Supervisor DeCarlo made a motion to rehire Patrolman Raymond Ashton as of 8/2/2019 at previous rate of pay of $18.55 per hour, seconded by Councilwoman Marien. 4 ayes, 0 nays. MOTION CARRIED.
NYS Office of Parks proposal to create new trail within Evangola State Park: Supervisor DeCarlo received a proposal to create a new trail at Evangola State Park and would like to have the approval of the board. There will be no cost to the Town. If the Town of Brant doesn’t respond, they will assume we have no objections.
REPORTS OF THE COMMITTEE:
Supervisor DeCarlo:
Announced that the new speed Limit Signs went up on Hardpan Rd.
DeCarlo received a request from a resident on Cain Road asking if the speed limit could be lowered to 45mph. Cain Road is a shared road with the Town of Evans. This was tabled.
Councilwoman Marien:
Reported that she helped with E-Waste and it went very well. She suggested the Town add a limit in the advertisement. People were coming with multiple of the same items, i.e. TV’s.
Councilman Muffoletto:
He said that yesterday (7/31/19) was the last day for the salvage yard to be open. He feels the reason they were moving were financial. Attorney Trask said that the Code Enforcement Officer should make a record of the day it shuts down operations because it is a non-conforming use.
Councilwoman Ross:
She asked when the construction will begin at the Senior Building because the Seniors keep asking when they need to move. Supervisor DeCarlo will let them know. They need to get going on the bids.
RECOGNIZED PRIVILEGE OF THE FLOOR: Chief Hepkins apologized for being late and asked if there were any questions regarding his report. There were none.
MEETINGS AND CORRESPONDENCE: The Supervisor said we received the July sales tax came in at 7.22% below the corresponding 2018. The year to date 2.2% above previous years.

Our next meeting will be on Thursday, September 5, 2019 at 7:00PM. Debra Ritz asked if the meeting could be moved back to Tuesdays. They will look into it.
EXECUTIVE SESSION: Supervisor DeCarlo made a motion to go to EXECUTIVE SESSION at 7:35pm to discuss Personal and Contractual items, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
Supervisor DeCarlo made a motion to close EXECUTIVE SESSION at 8:16PM, seconded by Councilwoman Marien. 4 ayes, 0 nays. MOTION CARRIED.
At 8:16 pm, Supervisor DeCarlo motioned to adjourn the meeting in memory of Brenda Mayne, Katherine Giambrone, Joan Butlak and Penny Serena, seconded by the balance of the Board. 4 ayes, 0 nays. MOTION CARRIED.
