April 1st Town Board Meeting


This Regular Meeting of the Brant Town Board was held on Tuesday April 1, 2025, at the Brant Town Hall, located at 1272 Brant North Collins Rd, Brant, New York at 7:00 PM.

The meeting opened at 7:00 PM with the Pledge of Allegiance to the flag.

 

APPROVE MINUTES of the MARCH 11, 2025 MEETING: Supervisor DeCarlo motioned to approve the minutes of the March 11, 2025 Regular Town Board meeting, and was seconded by Councilwoman Giancarlo. 4 ayes, 0 nays. MOTION CARRIED.

 

SUPERVISOR’S FINANCIAL REPORT: Supervisor DeCarlo motioned to approve the Supervisor’s Financial Report, seconded by Councilwoman Giancarlo. 4 ayes, 0 nays. MOTION CARRIED.

 

TOWN CLERK/TAX COLLECTOR’S FEBRUARY 2025 FINANCIAL REPORT: TABLED

 

COURT CLERK’S FEBRUARY 2025 FINANCIAL REPORTS FOR KACZMAREK & GIER REGULAR AND BAIL ACCOUNTS: Supervisor DeCarlo motioned to approve both Bail and Regular Financial accounts for Justice Kaczmarek’s & Justice Gier for February 2025, seconded by Councilwoman Giancarlo. 4 ayes, 0 nays. MOTION CARRIED.

 

POLICE REPORT FOR MARCH 2025: Police Chief Mark Slawek read the March Police Report. Supervisor DeCarlo motioned to approve the report, seconded by Councilwoman Brady. 4 ayes, 0 nays. MOTION CARRIED.

 

HIGHWAY SUPERINTENDENT’S REPORTS: Councilwoman Brady presented the Highway Superintendents March highway report. Highway Superintendent Ellsworth Nolan mentioned in his report a thank you to Allen Nolan for stepping up and running the Highway Department while he was on vacation. Supervisor DeCarlo then mentioned about the terrible winter we had and the shortage with salt and how the Highway Department did an excellent job with keeping the roads clear. Supervisor DeCarlo motioned to accept the report as read, seconded by Councilwoman Brady. 4 ayes, 0 nays. MOTION CARRIED.

 

TOWN CLERK’S MARCH 2024 ACTIVITY REPORT TO THE BOARD: TABLED

 

PLANNING BOARD REPORT: Planning Board Secretary Barbara Daniel stated that the March meeting was rescheduled to April 1st so there is no report.

 

ZONING BOARD REPORT: No Report.

 

PARK’S & BUILDINGS REPORT: No Report.

 

TOWN HISTORIAN REPORTS: TABLED.

 

BRANT FARNHAM SENIORS: Meeting is after the April TB meeting. April Report will be read at the May TB Meeting.

 

CODE ENFORCEMENT: Supervisor DeCarlo read the report. Supervisor DeCarlo motioned to accept the report as read, seconded by Councilwoman Giancarlo. 4 ayes, 0 nays. MOTION CARRIED.

 

OLD BUSINESS:

 

BRANT Memorial Park Spring Cleanup: Supervisor DeCarlo mentioned an estimate of $1960.00. He mentioned with Memorial Day coming up, he would like it cleaned up and looking nice. Attorney Trask asked about prevailing wage and Supervisor DeCarlo confirmed. Supervisor DeCarlo motioned to approve the discussion, seconded by Councilwoman Giancarlo. 3 ayes, 0 nays, 1 Abstain.

TOWN EQUIPMENT STORAGE LEASE: Councilman Muffoletto made a motion to ratify the agreement for storage of town equipment at 1007 Brant Farnham Road per the signed agreement. Seconded by Councilwoman Giancarlo. 4 ayes, 0 nays.

Special Use Permit for Jay Vacco 1132 Brant Farnham Rd: Supervisor DeCarlo stated that the SUP was approved at the last meeting but then had further discussion to amend the permit to add conditions to allow the draining of petroleum products on site and to maintain records proving they are properly handling and disposing of those materials and the CEO needs to be provided that proof upon request. Supervisor DeCarlo then motioned to approve the permit, seconded by Councilwoman Brady. 4 ayes, 0 nays.

CLARIFY SUP RENEWALS: Supervisor Mark DeCarlo then clarified that the two SUP that were approved last month for Vacco & Duncan Motors/Bowman that current SUP will expire June 30th 2026 at which time they can start their annual renewals. Supervisor DeCarlo then motioned to approve, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.

 

NEW BUSINESS:

 

  • Town of Brant’s Easter Egg hunt will be held on Saturday, April 19th 2025 at 1pm at the Brant Town Park.
  • E-Waste Collection will begin April 26, 2025 from 9-Noon and will follow every last Saturday of the month.
  • Brant FVC Ladies Auxiliary’s All You Can Eat Pancake Breakfast & Theme Basket Raffle will be held on Sunday April 13th between 8:30-Noon. Dine in only, $12/person, 5 and under are free.
  • 2025 Recreation Dates, Wages and Pool Fees will be discussed at the next Town Board meeting in May.

PARKS GRANT: The town is applying for a Parks Grant not to exceed $300,000; with a 10% match ($30,000). Supervisor DeCarlo requested to make a resolution to affirm the Parks and Recreation Master Plan done in 2000, this is a grant requirement. He also stated to make a resolution to demonstrate the town is ready to implement to the grant if funded. He stated that He and Councilwoman Giancarlo met to discuss updates and additions needed for the park, including improvements to the walking path, baseball field and so on. The Resolutions were then read:

 

RESOLVED:

Whereas an Advisory Committee was formed in August 2000 to review the Town’s parks and recreation needs and services, and

Whereas the Advisory Committee developed a five-year Parks and Recreation Master Plan which the Town hopes to implement to expand the parks and recreation availability and usage within the Town of Brant for citizens of all ages;

WHEREAS the Parks and Recreation Master Plan specifies the need for recreation improvements, including, but not limited to development of land adjacent to the Brant Town Park and rehabilitation of existing recreational amenities at the Brant Town Park.

NOW, THEREFORE, BE IT RESOLVED:

That the Town Board of the Town of Brant does hereby reaffirm the contents of the five-year Town of Brant Parks and Recreation Master Plan, and

BE IT FURTHER RESOLVED:

The Town of Brant Town Board will review said Parks and Recreation Master Plan on an annual basis, beginning one year from the date of this resolution.

Supervisor DeCarlo proceeded to read the second resolution:

 

Purpose: to authorize the Supervisor to submit a grant application for State funding assistance for the Municipal Parks & Recreation Program

WHEREAS, the adopted Town of Brant Parks Master Plan encourage the expansion of trail facilities in the Town; and

WHEREAS, the Town Board desires to provide safe, accessible and well-maintained trails for recreational use throughout Brant; and

WHEREAS, the Town Board desires to provide this type of facility to residents at the lowest possible cost to Town taxpayers; and

WHEREAS, the Town seeks to rehabilitate and expand the existing park amenities that have hindered the full potential of this park to be enjoyed by all residents;

 

WHEREAS, the additional outdoor recreation elements will provide enhanced opportunities for walking, biking, cycling, hiking and interpretive nature opportunities for health, wellness, and fitness purposes, and

WHEREAS, the Town Board commits to providing the required local matching funds of 10% using __A__ funds to ensure the timely implementation of the proposed project; now therefore be it

RESOLVED, Mark J. DeCarlo, Supervisor of the Town of Brant, is hereby authorized to sign an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of the Environmental Bond Act of 2022, requesting an amount not to exceed $300,000 and, upon approval of said application for funds to enter into and execute a project to execute the Master Contract with the State for such financial assistance to the Town of Brant for the Brant Town Park Rehabilitation: Phase II.

Now Be It Further Resolved that Connie D. Miner & Co. Grant Consultants be authorized and directed to complete the necessary application, forms, and attachments to be submitted through the New York State Consolidated Funding Application for the purpose of securing this grant; and,

Fiscal Impact: The implementation of this project will necessitate the expenditure of $30,000 to be used as a 10% match for the grant. The cash matching funds are proposed to come from the A7110.4.

TOWN BOARD REPORTS:

The Supervisor asked if anyone had anything to report.

PRIVILEDGE OF THE FLOOR: NONE

 

Meetings & Correspondence:

 

  • The first March sales tax remittance is in. The current transfer rate is 10.81% less than the corresponding 2024 amount. Year-to-date transfers are running 8.69% below year at this time.

 

 

SUPERVISOR DECARLO: He mentioned that he received an email from Lynda Ostrowski regarding voting at the Town Hall. He proceeded to summarize the email regarding concerns with having voting at the Town hall and stated that the email will be available at the Town Hall if anyone wanted to read it. Supervisor DeCarlo and the Town Board discussed the concerns but stated these concerns can be fixed. Supervisor DeCarlo did mention that the issues discussed last year were addressed and improvements were made. He stated that he addressed the Board about moving voting and the Board of Elections approved it but stated that it needed to be permanent. In the letter it stated that Supervisor DeCarlo made promises to them to which he responded that he made no promises about moving voting back to the Senior Building. He stated that comments were made by the inspectors to his family and friends while voting about him lying which he felt was inappropriate and wanted to make a public statement that he never made promises that it was not a permanent move and he apologized that they are not happy with it.

At 7:31 pm, Supervisor DeCarlo motioned to adjourn the meeting in memory of Scott “Skippy” McCrory and Patricia Wittmeyer, seconded by Councilman Muffoletto. 4 ayes, 0 nays. MOTION CARRIED.
