CODE ENFORCEMENT OFFICER’S JULY 2020 REPORT: Code Enforcement Officer Gary Brecker read the July report.

  1. advised the Board that Weitsman mowed their lawn on July 17, and he had advised them to mow it again on August 11. Supervisor DeCarlo motioned to accept the report as read, seconded by Councilwoman Giancarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

DOG CONTROL OFFICER’S JULY 2020 REPORT: Dog Control Officer Barbara Daniel presented her July report. Supervisor DeCarlo made a motion to accept the Reports as written, seconded by Councilman Muffoletto. 5 ayes, 0 nays. MOTION CARRIED.

 

POLICE REPORTS FOR JULY 2020: Chief Hepkins read the July 2020 Police Report. Supervisor DeCarlo made a motion to approve the report as read, seconded by Councilwoman Giancarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

HIGHWAY SUPERINTENDENT REPORT: Superintendent Nolan noted the highway crew will be chipping roads on August 12. He then presented the bid amounts for each of the items placed into surplus in June.

ADD THREE ITEMS TO SURPLUS LIST: Supervisor DeCarlo motioned to add 3 items to the list of surplus items to be sold at auction. The items were marked with an asterisk above. Councilwoman Ross seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

 

APPROVE BID AMOUNTS OF HIGHWAY SURPLUS ITEMS: At the recommendation of the Highway Superintendent, Supervisor DeCarlo motioned to approve the bid amounts of the items listed above at an online auction set to end on August 19. Councilman Muffoletto seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

Unrelated discussion prior to Weitsman hearing:

Supervisor DeCarlo inquired about the two upcoming Special Use Permit applications. One for Andrew Lonkey and the other for Donald Arcara. The Code officer responded that Andrew Lonkey was not ready for a permit yet.

 

As for the upcoming Special Use Permit for Donald Arcara. The Code Officer stated it was a new permit but almost seems he could use his previous permit. Supervisor DeCarlo then asked to table it so they can do a complete review of the application. Supervisor DeCarlo motioned to table this until the next meeting, seconded by Councilwoman Giancarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

Supervisor DeCarlo asked if the Code Officer had any comments regarding the permit for Ben Weitsman of Brant LLC. The Code Officer stated he had no comments.

Supervisor DeCarlo: Anyone in the general public want to speak? Yes, Ma’am.

 

Doreen Simmons: My name is Doreen Simons, I’m the attorney representing Weitsman. May I step up to the… (motioned to the microphone)

 

Supervisor DeCarlo: Yes, please.

 

Doreen Simmons: Thank you. As I stated, my name is Doreen Simons. I remember seeing some of you some years ago. I represent the Weitsman Entities that operates scrap yards including this scrap yard here in Brant. Mr. Aaron Weiner who has been here before is also with you. We came a long distance. We hope maybe that shows our appreciation for both this community, I came from Syracuse and Aaron from Rochester, and our respect for this Board and for our desire to have this special permit renewed. We want to thank you for that 30-day extension and have just a few comments. I don’t want to “over-lawyer” this but I thought it would be worthwhile to repeat where we are. I also want to complement your Town Attorney, Mr. Trask, who is always most gracious in taking our phone calls and educating many, many lawyers on your code and how it operates so I think he’s been around a while and our Historian should probably cover that.

 

But as you know, we are a non-conforming use, in a, I believe, a zoned rural-residential area and as such, we are permitted to continue under our code, but also, under section 161-35, this Board can request a special permit so there would be enhanced conditions associated with our operations. And so we just wanted to know that we do have that status as a non-conforming entity. I don’t think I need to re-iterate everything that was in the letter dated July 29, I know that was shared, Mr. Trask indicated that he shared that with all of you. Other than to say, I just like we’re all sitting here, masked, everyone in this room has been affected by COVID-19, so have our operations throughout New York.

 

Many of our operations, we have abbreviated hours, we have limited the public’s ability to come in to some of the yards, and certainly Mr. Weiner can address that. He’s assigned numerous different yards to assist as may be needed because of COVID. As you all know, the property has been for sale, it was for sale. We did not get a lot of attraction, and as a result the thought was to start to think about how we could use this property, which we pay taxes. We try to comply we certainly have complied with the conditions of the special permit because we have not been recently operating and there was a discussion to begin to utilize it as a transfer-type facility that wouldn’t necessarily, initially permit the public to come in with scrap. Hence you’ll see the sign that we are encouraging peddlers to go to Liberty. Under your definition of a “junk yard” under your code, certainly, it’s not necessary, under your definition, that the public be permitted to be present.

We also recognize that particularly with things settling a little bit, that there was a need, and we would like to thank you for the 30 day extension, for us to be able to go out and to better maintain the yard.

I received an email from one of the personnel at Weitsman requesting that I would be certain to advise this board that we have assigned a crew that every 2 weeks, a crew will be coming to the location. If you deem that would be appropriate to add as a special additional condition to our permit, we are prepared to accept that, so that every 2 weeks, a crew will be coming to maintain the yard.

We recently chatted with Mr…. your code enforcement, Gary Brecker, who has always been very courteous to us, and he noted 2 things when he came, which I don’t think you mentioned, Mr. Brecker, but I was told that we could do a little better job of mowing as you go in and out of the entranceway, and also, we have some bushes that were planted that really were not drought tolerant, and we all know we’ve had an extraordinary dry and hot season so our maintenance crew, when they come, they are supposed to come Thursday or Friday this week, again, they will come every 2 weeks. We’ve asked them to take a look at those bushes and address whether or not they need to be trimmed or replaced or what might be appropriate for them. They are not drought resistant, as I mentioned before.

So, with that, we renew our request for what the code permits as kind of an enhanced special permit, kind of frosting on the cake of a non-conforming use. And as you all know, we certainly, as I said before, we have complied with the provisions of our permit. We’re not looking for any changes. As far as hours of operation, lighting, traffic, limitation of vehicles, we are prepared to accept all that, which quite frankly, would be relatively easy for us to adopt as related to what we think would be the probable future cause. We hope that we don’t see a resurgence of COVID, that’s only going to introduce more issues. We are still in the bit of the planning stage, to give you any further details. Mr. Weiner is here, also, to answer any questions.
 

Councilman Muffoletto: Still not clear as to what you will be doing there. Are you going to resume as the previous permit or are you doing something different?

Doreen Simons: It would be…your code permits, the definition of a junk yard…..

Councilman Muffoletto: ….I’m asking you, are you doing what you did before or are you doing something different?

Doreen Simons: We are doing what we did before except there would be a limitation to the public coming in to the yard. I’m just a scrap lawyer… I’m not a scrap yard operator. I guess I’d ask Aaron to address

Councilman Muffoletto: It’s only going to be something that you bring in from everywhere else and then send it out?

Aaron Weiner: Right… from other businesses in the area that we would service, as opposed to servicing it out of Rochester or another location. We could still just bring it to that location until we have enough material to move it back out.

Councilman Muffoletto: What’s wrong with Buffalo? Don’t you have a place in Buffalo?

Aaron Weiner: No, we don’t have a place in Buffalo.

Councilman Muffoletto: Then why are you telling everybody to go to…where’s that sign tell people to go?

Aaron Weiner: Liberty Iron and Metal

Councilman Muffoletto: Where’s that?

Aaron Weiner: They’re in Buffalo.

Councilman Muffoletto: So you’re just giving them all your business?

Aaron Weiner: Well, yeah but we do some reciprocal business together so, you know, we help them out, get some material there, and do other business with them.

Doreen Simmons: We do have a facility, sir, in Jamestown.

Councilman Muffoletto: I know that. I just want to make mention about those bushes. When they were put in last year and they were dying immediately. I contacted Mr. Weitsman right away. He said he was told by the planter that they would be fine, they’re going to recoup and be great. Well, almost all of them are dead or almost dead.

Doreen Simmons: I saw that myself. I went to the property before I came here.

Councilman Muffoletto: Well, it’s been a year already.

Doreen Simmons: The tall ones?

Councilman Muffoletto: Yep

Doreen Simmons: And…again…this has been an extraordinarily dry season. I’m a gardener and a farmers’ daughter, so it’s been extremely dry.

Councilman Muffoletto: I’m saying they were dead last year, not this year.

Doreen Simmons: Yes

Attorney Trask: …I have a question whether Debbie’s comments are going to be picked up on the recorder.

Debbie Ritz:. I think that my questions are based on my confusion with the transfer station. Does that, to you or to the company, imply more traffic, less traffic? Is that going to be different than…

Supervisor DeCarlo: Maybe they can answer that.

Debbie Ritz: I know, that’s why I’m up here.

Supervisor DeCarlo: Can you?

Debbie Ritz: I can’t address them you will have to.

Supervisor DeCarlo: I know, that’s why I’m asking…

Councilman Muffoletto: That is a concern.

Debbie Ritz: That’s my question for the public to understand is that more traffic, less traffic? Do they still have to follow that because we had problems initially with traffic.

Supervisor DeCarlo: We did, yes.

Debbie Ritz: So, when I hear the word transfer station I get concerned about exactly what that means and will other facilities be bringing in huge amounts of scrap unlike what the public was bringing in, and then what happens?

Supervisor DeCarlo: Ok, that’s a good question.

Debbie Ritz: So now I go back?

Supervisor DeCarlo: Yes, thank you. Can you address that?

Aaron Weiner: Do you want me to come up there?

Supervisor DeCarlo: Yes, please. Sorry.

Aaron Weiner: To answer that question, the traffic would be significantly less.

Supervisor DeCarlo: Ok

Aaron Weiner: This might be a couple trucks a week. Nothing like it was before.

Supervisor DeCarlo: Carried. I guess what I’d like to do, unless maybe, I guess I’d like to have an up or down vote I guess on the renewal of the current special use permit. So I’d make a motion to renew Weitsman of Brant’s current special use permit

Attorney Trask: To operate a junk and salvage yard.

Supervisor DeCarlo: To operate a junk and salvage yard, the same current

Attorney Trask: The same conditions but if you want to, Council invited you to add another condition for the maintenance, continued maintenance of the site.

Supervisor DeCarlo: Bi-Weekly basis, correct? So I guess for the same conditions and same operations as the previous permit for a period of 12 months, adding…

Attorney Trask: I’m sorry. It actually it would expire as all of our special use permits do, June 30 of 2021.

Supervisor DeCarlo: June 30 of 2021, adding the one additional condition of an every two week maintenance crew, I guess doing monitoring and doing maintenance on the property. Is there a second?

Councilwoman Giancarlo: I’ll second.

RESIGNATION OF OFFICER RALPH MASLACH: Supervisor DeCarlo read a letter of resignation from Officer Ralph Maslach. Mr. Maslach is retiring effective July 31st, 2020. Supervisor DeCarlo motioned to accept the resignation, seconded by Councilwoman Giancarlo. 5 ayes, 0 nays. MOTION CARRIED.

 

APPROVAL TO HIRE PART-TIME BLDGS & GROUNDS LABORER: Supervisor DeCarlo motioned to approve the hiring of Davis Glashauser as part-time Buildings and Grounds laborer at $14.00 per hour as needed. Councilwoman Marien seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

 

RESOLUTION ADOPTING NEW RECORDS RETENTION SCHEDULE TO REPLACE THE CURRENT MU-1 SCHEDULE:

Supervisor Mark DeCarlo read the following resolution to adopt the new Records Retention schedule that will be effective January 2021:

 

RESOLVED, By the Town Board of the Town of Brant that Retention and Disposition Schedule for New York Local Government Records (LGS-1), issued pursuant to Article 57-A of the Arts and Cultural Affairs Law, and containing legal minimum retention periods for local government records, is hereby adopted for use by all officers in legally disposing of valueless records listed therein.

FURTHER RESOLVED, that in accordance with Article 57-A:

  1. only those records will be disposed of that are described in Retention and Disposition Schedule for New York Local Government Records (LGS-1), after they have met the minimum retention periods described therein;
  2. only those records will be disposed of that do not have sufficient administrative, fiscal, legal, or historical value to merit retention beyond established legal minimum periods.

Supervisor Mark DeCarlo motioned to adopt the resolution as presented, seconded by Councilwoman Marien. 5 ayes, 0 nays. MOTION CARRIED.

 

BRANT COURT TO RESUME D.A. NIGHT ONLY: Supervisor DeCarlo announced that Brant Court will now be open for D.A. night only beginning Thursday August 13 with presiding Justice Gier. Brant Court will be following local, State and Federal COVID-19 safety guidelines.

SET FEE FOR SOLAR PROJECT APPLICATION FEE & AMOUNT OF ESCROW ACCOUNT: Attorney Trask advised that an Escrow Account does not kick in until there has been a positive declaration by the lead agency for the proposed Solar Project. He added that at that point the SEQR regulations allow the municipality to require the applicant to set up an escrow account to cover consulting fees such as legal and engineering costs. These expenses are on a case by case basis which is dependent on the size and scope of the project.

He then addressed the permit application fee, noting that other Towns are adopting the application fee of $500.00 for the first 5 acres or less, and $250.00 for each addition 5 acres of less. He addressed the current application for 13.5 acres would translate to $1,000.00. Meaning $500.00 for the first 5 acres, $250.00 for the second 5 acres and $250.00 for the next 3.5 acres for a total of $1,000.00.

 

Supervisor DeCarlo then motioned to adopt the $1,000.00 (One thousand Dollar) application fee for the current solar farm application to be built on the Sager property. Councilwoman Giancarlo seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

 

DECLARATION TOWN OF BRANT AS LEAD AGENCY REGARDING PROPOSED LOCAL LAW #2-2020: Supervisor DeCarlo made a motion to declare the Town of Brant as lead agency with regards to proposed local law #2-2020. Councilwoman Giancarlo seconded the motion. 5 ayes, 0 nays. MOTION CARRIED. PROPOSED LOCAL LAW #2-2020 TO BRANT PLANNING BOARD PURSUANT TO BRANT CODE SECTION 161-72: Supervisor Mark DeCarlo motioned to refer the review of proposed local law #2-2020 to the Town Planning Board to produce a report to the Town Board. Councilwoman Giancarlo seconded the motion. 5 ayes, 0 nays. MOTION CARRIED.

Councilwoman Ross: Noted that the M.S. run was a no show. They were scheduled to use the Sr. Community

Supervisor DeCarlo: Discussed the closing of the pool at the end of August.
