Acknowledgement of Dignitaries and Invited Guests:  
Supervisor Pero introduced Betty and John O?Donnell of Brant and read a Proclamation proclaiming recognition for their effort and dedicated service with the Energy Fair and naming Saturday October 24th, as Betty and John O?Donnell Day.  
Betty and John accepted the proclamation and stated that many others helped very much with the Fair.

OLD BUSINESS: 
LGE 
Board members acknowledged attending the last Village Board meeting and Kujawinski had discussion after Pero read resolution as it was amended from last month and inquired if Village also passed same. Pero stated this is to look at all departments it is not just singling out those two departments (DPW & Highway). 
Councilman Fullone moved to adopt the following #280, seconded by Councilman Turner.

Turner stated this is nothing more than a study; this isn?t taking away any jobs or going after any department.  
# 280 RESOLVED: Whereas the State of New York, Department of State is soliciting applications from local governments under the Local Government Efficiency (LGE) Grant Program for the year 2009-2010, for collaboration between communities to promote Shared Services; and

Whereas the Village of Farnham and the Town of Brant would consider and intend to evaluation the potential merging of certain services, in order to reduce costs to its taxpayers; and

Whereas the Village and Town would consider and intend to evaluate the potential merging to provide similar or increased efficiency of service to its residents with a reduced cost to both Municipalities and their taxpayers; and

Whereas the NYS LGE grant program, under the category of General Efficiency Planning grants, would award a maximum of $25,000 for an application submitted by two (2) municipalities; and

Whereas each municipality agrees to provide an equal share of the required 10% local funding match of the grant award to study the feasibility of merging , sharing, or consolidating the functions for the two (2) municipalities; and 

Whereas both Municipalities have agreed to cooperate in the submission of the application for funding, and to cooperate in the feasibility study itself; and 

Whereas the Village of Farnham would act as the Lead Agency, representing the two (2) Municipalities and entering into a contract with the State of New York, Department of State on behalf of the Village of Farnham and Town of Brant; 

Now therefore be it resolved that the Town of Brant supports the completion of a joint feasibility Study for the Village of Farnham and the Town of Brant to consider the sharing and/or consolidation of services.

Be It Further Resolved that the Town Board of the Town of Brant is hereby in agreement to file a joint application with the Village of Farnham to request funding for a General Efficiency Planning Grant under the New York State, Department of State Local Government Efficiency (LGE) Grant Program 2009-2010, for a Feasibility Study.

#281 RESOLVED: THE TOWN BOARD HEREBY AUTHORIZES THE EXPENDITURE OF $1,500.00 FOR MATCHING FUNDS WITH THE VILLAGE FOR THE LGE GRANT IF AWARDED TO THE MUNICIPALITY.  

The refuse committee: Gier & Kujawinski met with Attorney Grennell and amended the bid spec?s.  Discussion included concerns such as insurance, length of contract, etc.

CDBG Public Hearing: 8:00 PM 
Town Clerk, Thea Ells read the following notice which she verified was published in the legal paper of the Town, ?SUN?, and posted on the Clerk?s signboard and Brant and Farnham post offices. 
THE TOWN OF BRANT will hold a Public Hearing on Tuesday October 13th, 2009 at 8:00 PM at the Brant Town Hall, 1294 Brant North Collins Rd., Brant, New York, Regarding the use of Federal Community Development funds in the Town of Brant. THE TOWN OF BRANT is eligible for a Federal Community Development grant under Title I of the Housing and Community Development Act of 1974, as amended. 
THE PURPOSE OF the hearing is to provide an opportunity for Citizens to express Community development and housing needs and to discuss possible projects which would benefit low and moderate income persons in the Town of Brant. CITIZENS ARE URGED to attend this meeting to make known their views and/ or written proposals on the Town of Brant?s selection of potential projects to be submitted for possible funding by the Federal Community Development Grant Program. THE HEARING WILL also present a review of prior Community Development projects and expenditures and a discussion of eligible activities. The meeting room is wheelchair accessible. #283: RESOLVED: TO OPEN THE PUBLIC HEARING @ 8:00 PM 

Supervisor Pero read the proposed list of projects in the Town of Brant;
Number three is always Rural Transit; number two will be Farnham Park Improvements Phase I, and number one is a repairing the sidewalk along Brant North Collins Road near the Elementary School.  Supervisor Pero reviewed the proposal for the sidewalk. Discussion was held concerning other sidewalks being blacktop, concerns with Route 249 being a state road and questions of drainage, grade of road, private property and instances of when the children use the sidewalk.  
Supervisor Pero reviewed the recent grants received through the ECCDBG and how fortunate the Town has been with these grants, listing: Recreation Fitness Center, Four Corners Memorial park, and Wading Pool.

#285: BE IT RESOLVED THAT Councilman Fullone made a motion, seconded by Councilman Turner, that as Supervisor of the Town of Brant, Leonard K. Pero is hereby authorized and directed to sign, submit and execute a contract with Erie County Community Development Block Grant (ECCDBG) program for the following projects upon approval of ECCDBG.
1) Four Corners Sidewalk Rehabilitation Project, with a total project cost of 	$42,000.00 to be matched by 25% using a combination of force account 	labor ($5,000.00) from the Town?s Highway Department and in $5,500.00 	from the sidewalk line item A5410.2.	
2) Village of Farnham Recreation Park/Playground Project ? Phase 1 	Completion ? Total Project Cost of $127,900.00 with $27,900.00 Local 	Match in kind services of $27,900.00   
3) Rural Transit 

 Parking Area for V&T Court Nights
Last month Board members discussed parking issues during V&T court nights. Pero stated that the Judges should be included in review of parking issues and will update again next month. 

Town Board Meetings Audio On- Line
Audio Recordings of Town Board Meetings proposal to put online. Correspondence from Internet Services quoted for MP3 download on town website @ 12 per year would be $220.00. Clerk noted it would be more for extra meetings. Supervisor Pero moved for adoption of the following 286, seconded by Councilman Fullone.

#286: RESOLVED: THE BRANT TOWN BOARD HEREBY AUTHORIZES WEB MASTER BARBARA DANIEL TO WORK WITH INTERNET SERVICES AND HAVE THE AUDIO OF TOWN BOARD MEETINGS DOWNLOADED AS AN MP3 FILE ONTO THE BRANT TOWN WEBSITE. 

Erie County AG Public Notice: Supervisor Pero read the notice which states designated dates of 11/1/09 thru 11/30/09 as the annual thirty day time period within which a land owner may request predominately viable agricultural land for inclusion to a certified agricultural district in accordance to a Section 303-b of NYS Agricultural and Markets Law.

Audit UCJA- Pero reported ? they are working on it now  

LSYF Light Poles ? Other poles were not sufficient and LSYF reported that they found a company in Ohio where they could purchase new poles next spring. LSYF teams are doing well this year.   

Wind Energy: Supervisor Pero has spoken with several wind development companies.
 
Water Project: Rural Development stated the Town is eligible for funding due to low income. Pero stated inclusions to the system would be possible. 



SIT Update 
Discussion on the Southtowns Inter-community Transportation Proposal.  Pero reported that other towns would pick up difference if a community does not join in, discussion continued with concerns to amend resolution # 259 so Town is included in proposal even if all seven towns do not join in and cost is the same. Supervisor Pero reported that he received monies from some grants: BUNY: $1920.00 and Stop DWI 
School Taxes: Acknowledge that Diana Cafferty did collect Evans Brant School District Taxes in The Brant town Clerks Office on October 9th. 
Storm Water Drainage 
Update from Bob Reynolds with ideas to form districts to enable application for monies from the State. 
Brant School Emergency Response Drill
Disaster drill at Brant Elementary School went well with an evacuation and pick up at the Town Hall. 
Resolution Coalition Government: Tabled
Supervisor Pero read a resolution entitled ?Reform Erie County Government for the good of the people?
Whereas: 40 years ago Erie County was directed by a Board of Supervisors
Whereas: In recent years the 20 legislators have been reduced to 15 due to the population shifts, thus giving us less representation. 
Whereas: The legislators have worked hard but with less representation, they do not have their hand on the pulse of our communities as the Supervisors and Mayors do. 
Whereas: The Supervisors and Mayors are the people?s first choice and the layer of government directly responsible to them.
Therefore: This plan that we would like to share and introduce to you, is a very fair and equitable plan. It will trim down government and help to reduce the fat in our county government.  
 Whereas: The plan would be a new concept with a regional flair similar to a Board of Supervisors with a twist. It would be a hybrid of combining both Local & County government into a more efficient cost savings government.  
Whereas: It would involve the County Executive, Legislature, Towns, Cities & Villages and combining everyone into a coalition government. All the communities would keep their identity, but working together would keep costs down, communications up and vital services intact. 
Whereas:  The Legislature would be reduced but the new board would include some supervisors or mayors bringing about more representation with less cost. 
Whereas:  This new concept of shared intra municipal government with an equal voice with common issues would be known as The ERIE COUNTY COALITION GOVERNMENT.
Whereas:  The county would be divided into 5 coalitions with the city of Buffalo divided separately if they choose to do so creating 7 coalitions.
Whereas:  Each coalition would consist of 5 ? 13 communities based on the population (of 120,000 ? 170,000 in each coalition) and the geographic location to one another because they have similar issues to deal with and within these coalitions they work together on shared services creating IMA with each other.
Whereas:  Each Coalition will have two representatives (Legislator & local Official) that will have two votes county wide; this will bring equal representation to each coalition and within these coalitions they work together on shared services creating IMA (inter municipal agreements) with each other.
Whereas: The Erie County Legislature would be reduced to 7 and the Coalition heads would add up to another 7 giving the people of the county 14 representatives plus the County Legislator (15) and the savings would be Approximately $1,000,000.
Whereas: The local representative (Mayor or Supervisor would be selected by lot from the municipal leaders in their coalition and only serve one year, with this position rotating each year. 
Whereas: Within each coalition all the communities may work on projects together sharing of equipment and services with IMA?s and the purchasing of bulk materials & sharing of services would bring about millions of dollars in savings. 
Whereas: County highway work force could be reduced through buyouts and much of the work on roads could be done by the local communities. 
Also: The concept of forming coalitions would help to reduce the tax burden placed on the tax payers by the school districts.
Whereas: The cost to school Districts would be reduced within each coalition and ultimately the savings to the County would be approximately 20 million dollars. 
Whereas:  Schools do not lose their identity and the unpopular idea of merging school districts would not have to be done.
Whereas: Districts would save on purchasing, (sports equipment, office supplies etc.) also busing and administrative staffs. 
Therefore: The impact of this Coalition Model would be enormous for the Tax payers of Erie County and would bring about a complete turnaround in saving tax payers dollars which could bring about public confidence and bring business and industry back to all of Erie County.
      NOW Therefore BE IT:  
RESOLVED, that the Erie County Legislature should give authority to a study and form a commission, committee or a panel to review this concept and it?s feasibility to save the tax payers of our county millions of dollars and if it is feasible, that we implement it as soon as possible to bring about an economic resurgence for our county and its people.
RESOLVED, that certified copies of this resolution be transmitted to all 15 of the Erie County Legislator?s, and the County Executive of Erie County, and to the Supervisor or Mayor of every Town, City, and Village in Erie County.

Net Metering: Pero reported that 30% of the energy produced is coming to the Town and 70% going back to grid, partly due to the fact that our unit is bigger than accounted for in current legislation.
