MINUTES OF 5/23 SPECIAL MTG


Report of the Special Meeting of the Brant Town Board held on Friday May 23 at 6:30 PM, 1294 Brant NC Rd, Brant, New York at the Brant Town Hall.

ATTENDANCE: 
Supervisor Leonard Pero, Councilwoman Roseann Turner, Councilman Jeffrey Gier, Councilman Daniel Kujawinski, Councilman Vincent Fullone
Thea A. Ells, Town Clerk, John Grennell, Town Attorney.
Attendance: 
Thea Ells verified that all Board members notified and this meeting was posted at the Town Hall and web site, and SUN notified and News inquired.  
The meeting was called to order by Supervisor Pero at 7:30 PM with a pledge to the flag.

Supervisor Pero and Councilman Gier reviewed the bids received for the emergency job of placement of a new well due to failure of the tests on the old well by Erie County Health Department. 
Bids were received via fax per specifications from Erie County Health Department for a well for public use. Two bidders responded and a third was unavailable for work.
Wiley Well Driller: $8,230.00 / Ehmke: $9,960.65 
Councilman Gier moved for adoption of the following 080523-184, seconded by Councilman Kujawinski  A roll call vote was taken: Gier?aye, Kujawinski-aye, Fullone-aye, Turner-aye, Pero-aye, 5 ayes, 0 nays  
080523-184: RESOLVED: Award emergency well drilling to low bidder, Wiley Well Drillers, and to begin in aprox. three working days from confirmation of attorney that all contract items, wage requirements, necessary insurance and proof of insurance is met to attorneys standard. 
	
Pero would like to go on record along with Fullone that Joe Giambrone stated to them that he and the workers would not be doing any work on parks /grounds, buildings etc. unless Town paid insurance increase-this is in reference  to his job as Superintendent of Buildings and Grounds, Giambrone informed that it would be a advisory position only. 
Board members discussed concerns with issue, DPW.  

Supervisor Pero moved for adoption of the following 080523-185, seconded by Councilman Gier A roll call vote was taken: Pero-aye, Gier?aye, Turner-aye, Fullone-aye, Kujawinski-aye 5 ayes, 0 nays  
080523-185: RESOLVED: Approved to hire Jake Graci for labor in the Parks to scrape clean and paint picnic benches @ same rate of pay 

Pero read letter received from D. Ritz concerning rental on May 3rd at the recreation building concern over wet floors wet gym floor and possibility of contaminated water.  
Boards response - do not drink water signs, are up as of 2006 and wet/damp floors are always an issue ? Councilman Gier moved for adoption of the following 186, seconded by Supervisor Pero. Pero, Gier, Turner, Fullone, Kujawinski 5 ayes: 0 nays 
080523-185: RESOLVED: To refund rental fee to D. Ritz with a letter of apology for any inconvenience. 

D. Ritz letter also referring to time and date of meeting - Board response ? due to time requirements no other date available for compliance with rules.

Clerk Thea Ells informed Board she moved Sunday May 5th rental to SCB. 
Supervisor Pero moved for adoption of the following 186, seconded by Councilman Kujawinski. 5 ayes: Pero, Gier, Turner, Fullone, Kujawinski 0 nays  
080523-186: RESOLVED: Approval not to charge any increases if anyone moved to SCB due to park/water issues.
 
Councilman Gier moved for adoption of the following 187, seconded by Councilman Kujawinski. Pero, Gier, Turner, Fullone, Kujawinski 5 ayes: 0 nays 
187: RESOLVED: To go to executive @ 6:30 for police department personnel issues

Gier excused himself from meeting during executive session

Supervisor Pero moved for adoption of the following 188, seconded by Councilman Turner. Pero, Turner, Fullone, Kujawinski 4 ayes: 0 nays 
188: RESOLVED: To close executive session @ 7:30

Supervisor Pero moved for adoption of the following 080523-189, seconded by Councilman Turner A roll call vote was taken: Pero-aye, Turner-aye, Kujawinski-nay Fullone-aye 3 ayes, 1 nays  
080523-189: RESOLVED: Approve to send Officer David Hock to school for data master compliance for the Town of Brant and to receive a regular week pay.

Police Commissioner Pero is requesting from Chief Felschow for police officer duty schedule to be reviewed and approved by him and is asking for each Monday a police report of complaints and calls to be given to him for the prior week.
 
Pero gave to Clerk and Board members an opinion from 1980 concerning formation of police department and the office of police commissioner. (Office of Attorney General- from Nexius law).  

Supervisor Pero moved for adoption of the following 190, seconded by Councilman Turner. Pero, Turner, Fullone, Kujawinski 4 ayes: 0 nays 
190: RESOLVED: To adjourn the special meeting of May 23, 2008 @ 7:40 PM
