TOWN OF BRANT PLANNING BOARD MINUTES For meeting held TUESDAY, AUGUST 28, 2007 1294 Brant-North Collins Road Brant, New York 14027 Planning Board Meeting Joseph Gardyjan, Chairman IN ATTENDANCE: Joseph Gardyjan Also Attended by: Mr & Mrs Clapper (applic) Michelle Hy Gary Brecker (Code Officer) Tom Gerace, Jr Jeff Gier (Councilman) Patricia Brady Jamey Solecki The Town of Brant Planning Board held its regular meeting on August 28, 2007. The meeting was called to order by Joseph Gardyjan at 7:10 PM. Mr. Gardyjan motioned to accept the minutes of the previous month?s meeting held July 24, 2007. Tom Gerace seconded the motion. All approved. NEW BUSINESS. The Planning Board reviewed the application for variance submitted by Mr & Mrs Clapper of 1892 Halley Road. The applicant permit application to construct a new detached 2 car garage adjacent to the driveway was denied by the code officer for failing to meet minimum setback requirements as stipulated in the Town of Brant?s schedule of use, area and bulk. The proposed build required at least an 80 ft setback from the road right of way. Theirs was only 50 ft from the road right of way. The board discussed other options with the applicants as to location of the build, etc. However, all options had been studied by the applicant?s contractor and the location requested was the only feasible one. The applicants explained that a gulley impedes the setback. The layout of the utilities further limited the location. The front yard was not an option either as it was where their well was located. After review and discussion, Michelle Hy motioned to accept the application based on the limiting factors mentioned in the previous paragraph. Joseph Gardyjan seconded the motion. All approved. Motion passed. OLD BUSINESS. The Board received a copy of the Hamburg WEC law and chose to review the law at their homes for later discussion at the next meeting on September 25, 2007. The members also reviewed the Public Notice regarding the Castle re-zoning application and noted that a rezone would be futile since trucking operations are not even listed as an approved use under Commercial zone permitted uses.
