MINUTES OF WORKSHOP 8-9-07


Report of the Workshop of the Brant Town Board which was held on Thursday August 9, 2007 at 7:30 PM, 1000 Brant Farnham Rd, Brant, New York at the Brant Senior Community Bldg. ATTENDANCE: Supervisor Leonard Pero Councilman John D. Arrigo Councilman Jeffrey W. Gier Councilwoman Roseann Turner Councilman John J. Chiavetta Thea A. Ells, Town Clerk William J. Trask Sr., Town Attorney Attendance: Lee Brunelli, Charles Arrigo, Joe Gardyjan, Judge Ritz, George Cordia, Dave Gierlinger, Christine Gierlinger, Kirk Ritz Pledge to the Flag: Meeting called to order by Supervisor Pero. Clerk verified that this workshop which is on the annual list of meeting; and was posted at the Town Hall, Brant Post Office, Farnham Post Office, Town Crier and Town web site. Items for Review Rezoning Request/Castle/Versailles Plank Road: Town Attorney Bill Trask reviewed the procedure with the Board members ? reviewed by the planning board/ report to Town Board: this has been done, set public hearing/proposed rezoning sent to Erie County pursuant to General Municipal law 239-m. Justice Court Grant: Judge Debbie Ritz discussed a grant application for Justice Court Assistance program which the Town has received funding from for numerous years ? this year Judge Ritz has completed an application for what would result in a security assessment of the Town Hall and Meeting/Court Room, and possible award of video surveillance, hand held metal detector and or standalone unit. Judge Ritz asked for a response to the correspondence she sent to Supervisor Pero in April concerning some budget issues and procedure for billing, deposits, and reports. Health Insurance: Board discussed increase and change in premium which has the dental under another source and therefore an increase will be in place ? board needs to vote 8-14-07 Assessor: Board members will need to address the appointment of the Assessor for the next term which would run till September 30th of 2013 per Real Property Law 310. Basketball/Tennis Courts: Councilman Gier reported that the Town Clerk has the insurance certificate for Latak Blacktopping and the work on the Basketball/tennis combo court would start in approximately two weeks and the company would start on courts and then work on the sidewalks while the posts settle, etc. Councilwoman Turner moved for the adoption of resolution 159-07, seconded by Councilman Arrigo 5 Ayes Pero, Arrigo, Gier, Turner, Chiavetta 0 Nays ADOPTED: FOR THE TOWN BOARD TO GO INTO EXECUTIVE SESSION TO DISCUSS PERSONNEL MATTERS FOR THE POOL AND POLICE DEPARTMENTS @ 7:55 PM Councilwoman Turner was absent for the remainder of the meeting after 9:00 PM Councilman Chiavetta moved for the adoption of resolution 160-07, seconded by Councilman Gier 4 Ayes Pero, Arrigo, Gier, Chiavetta 0 Nays ADOPTED: FOR THE TOWN BOARD TO CLOSE EXECUTIVE SESSION @ 9:15 PM Councilman Gier moved for the adoption of resolution #080907-161 seconded by Councilman Arrigo, A roll call vote was taken: 4 Ayes 0 Nays Councilman Gier Voting Aye Councilman Arrigo Voting Aye Councilman Chiavetta Voting Aye Supervisor Pero Voting Aye ADOPTED: RESOLVED THAT THE TOWN ATTORNEY IS DIRECTED TO SEEK THE ASSISTANCE OF THE NEW YORK STATE COMPTROLLER IN CONDUCTING A COMPLETE AND THOROUGH FINANCIAL AUDIT OF THE TOWN OF BRANT POLICE DEPARTMENT FOR THE PERIOD MAY 1, 2006 TO THE PRESENT. Councilman Chiavetta moved for the adoption of resolution #080907-162 seconded by Councilman Arrigo, A roll call vote was taken: 4 Ayes 0 Nays Councilman Chiavetta Voting Aye Councilman Arrigo Voting Aye Councilman Gier Voting Aye Supervisor Pero Voting Aye ADOPTED: RESOLVED THAT THE TOWN ATTORNEY IS DIRECTED TO SEEK THE ASSISTANCE OF THE ERIE COUNTY DISTRICT ATTORNEY IN CONDUCTING A COMPLETE AND THOROUGH INVESTIGATION OF APPARENT IRREGULARITIES INVOLVING THE SUBMISSION AND PAYMENT OF TOWN OF BRANT VOUCHER NO. 600 FROM ABSTRACT 13 OF 2006. Councilman Chiavetta moved for the adoption of resolution #080907-163 seconded by Councilman Arrigo, A roll call vote was taken: 4 Ayes 0 Nays Councilman Chiavetta Voting Aye Councilman Arrigo Voting Aye Councilman Gier Voting Aye Supervisor Pero Voting Aye ADOPTED: RESOLVED THAT POLICE OFFICER DAVID HOCK IS HEREBY IMMEDIATELY SUSPENDED FROM ALL DUTIES WITHOUT PAY AND FOR AN INDEFINITE PERIOD OF TIME PENDING THE FINANCIAL AUDIT AND THE INVESTIGATION REFERENCED IN THE PROCEEDING RESOLUTIONS #080807-161, AND #080907-162, PENDING FURTHER ACTION OF THIS TOWN BOARD Councilman Gier moved for the adoption of resolution 164-07, seconded by Councilman Chiavetta 4 Ayes Pero, Arrigo, Gier, Chiavetta 0 Nays ADOPTED: TO ADJOURN THE AUGUST 9TH TOWN BOARD WORKSHOP AT 9:30 PM Respectfully submitted, Thea Ells, Brant Town Clerk
